Welcome to Praia Hotel, Boutique & Apartments

The following terms and conditions govern the use of our services and your stay at Praia Hotel, Boutique & Apartments (the “Hotel”). By making a reservation, checking in, or using our services, the guest agrees to comply with these terms. We recommend that you carefully read these terms.

1. Reservations

1.1 Reservation Process: Reservations can be made through our website, by phone, email, or through third-party booking channels. A reservation is considered confirmed when the Hotel receives full payment, which includes the base rate, applicable taxes, and cleaning fee.

1.2 Required Information: When making a reservation, guests must provide accurate information, including, but not limited to, name, contact details, and payment information. Additionally, guests must submit a clear photo of their passport or ID (without fingers or edits) in the name of the person making the reservation, as well as the individuals who will be staying with them. The Hotel may also request a selfie of the person making the payment along with their ID for verification purposes.
1.3 Cancellation Policy: All reservations are non-cancellable. Once a reservation is made, it cannot be cancelled or refunded.

2. Check-In and Check-Out

2.1 Check-In: Check-in is available from 3:00 PM. Guests will receive an entry code at the time of check-in, which they will use to access the hotel through a smart lock. Early check-in may be available for an additional charge of $50, subject to availability.

2.2 Check-Out: Check-out must occur before 11:00 AM. Late check-out may be available for an additional charge of $50, subject to approval. Guests who fail to check out at the designated time may be subject to additional charges, including a full additional night’s charge for an extended stay.

2.3 Minimum Age: The guest must be at least 18 years old to make a reservation or check-in.

2.4 Children and Legal Guardians: Any child must be accompanied by an adult who is their legal guardian. The adult will be fully responsible for the child throughout the stay, including any damage caused by the child. The Hotel will not be held liable for the child's well-being or behavior during their time at the Hotel. Any damage caused by the child will be paid for by the person who made the reservation.

3. Rates and Payments

3.1 Prices: Room rates are provided at the time of booking and cannot be changed. Prices may vary based on availability and seasonality, but once a reservation is confirmed, the price is locked and will not be altered.

3.2 Deposits: The Hotel may require a deposit upon check-in.

3.3 Taxes & Cleaning fee: If the reservation indicates that taxes and cleaning fee are included, it means they are included in the price. If not, taxes, cleaning fee and/or additional fees are not included. Taxes and cleaning fee must be paid prior to check-in. Failure to pay the required taxes and fees may result in the reservation not being confirmed and could lead to its cancellation.

4. Pet Policy

4.1 Pet-Friendly: The Hotel is pet-friendly. There is a $50 fee for each pet. Failing to notify the Hotel of the presence of a pet prior to check-in will result in an additional $500 fine. Pets must be accompanied by valid health documentation and must not disturb other guests.

4.2 Guest Responsibility: Guests traveling with pets are responsible for ensuring that their animals do not disturb other guests. The Hotel reserves the right to ask any guest with a disruptive pet to leave without a refund. All pet waste, including feces, urine, hair, and other debris, must be cleaned up by the pet owner immediately. Failure to do so may result in an additional charge. Furthermore, guests are responsible for ensuring that their pet does not cause any damage, chew, or break furniture or other items in the room or any areas of the Hotel. Any damage caused by the pet will be charged to the guest.

4.3 Pet Liability and Responsibility: The Hotel is not responsible for any injury, damage, or harm that may occur to a pet during the stay, including but not limited to bites or death. Pets must always wear a collar, and if necessary, a muzzle. The pet owner is fully responsible for any damage caused by their pet to other guests, pets, or hotel property. If a pet causes harm, injury, or death to another person or animal, the pet owner will be held financially responsible. Similarly, the Hotel is not liable for any injuries, damage, or death caused by other guests’ pets or persons to the guest’s pet.

5. Use of Room

5.1 Room Usage: The room is provided solely for the accommodation of registered guests. Guests are not allowed to exceed the maximum occupancy stated at the time of booking. The room may not be used for any illegal activities, commercial purposes, or any other purpose that may disturb other guests.
5.2 Condition of the Room: Guests are expected to keep the room in good condition and to avoid causing damage to hotel property. Any damage to the room, furniture, or hotel property caused by the guest will result in additional charges for repairs or replacement.

5.3 Noise and Disturbance: To ensure a comfortable experience for all guests, noise levels in the room must be kept at a reasonable level. The Hotel reserves the right to ask guests to leave if they cause excessive noise or disturb other guests. No loud music, parties, or disruptive behavior will be tolerated.
5.4 Smoking Policy: All rooms are non-smoking. Smoking inside the room or in any areas of the Hotel designated as non-smoking will result in a cleaning fee and additional charges. If the room smells of smoke, a $400.00 cleaning surcharge will be charged to the guest. Smoking is only permitted in designated outdoor areas.

5.5 Cleaning and Housekeeping: Daily housekeeping services are not provided during the stay. Cleaning is performed at check-out. If the guest requires extra cleaning during their stay, they must contact the Hotel, and additional charges will apply. Guests are responsible for keeping the room reasonably tidy. In case of excessive mess or if the room requires additional cleaning due to guest behavior, an additional cleaning fee may apply.

5.6 Liability for Lost or Stolen Items: The Hotel is not responsible for the loss or theft of any personal items in the room. Guests are encouraged to use the in-room safe for valuables.

5.7 Room Key and Access: Guests are responsible for their room key. If the room key is lost or damaged, a replacement fee will be charged. Room access is granted only to registered guests and may be revoked if security policies are violated.

5.8 Extended Stays: If the guest wishes to extend their stay, they must notify the Hotel as soon as possible. The Hotel reserves the right to refuse an extension based on availability. Any extension will be subject to the same terms and conditions as the original reservation.

5.9 Room Access and Key: Entry to the Hotel and room is made with a unique code sent to guests at check-in, which will be used on the smart lock at the entrance. The code is unique to each reservation and is valid only for the duration of the reservation; once the reservation ends, the code will be blocked. If the code is shared with third parties, the reservation holder will be responsible for any damage caused by those third parties. The Hotel reserves the right to block or deactivate the code at any time. Guests are responsible for their access code or room key. If the key is damaged, a replacement fee will be charged. Room access is granted only to registered guests and may be revoked if security policies are violated.

6. Sexual Offenses

6.1 Zero Tolerance Policy: The Hotel has a zero-tolerance policy towards any form of sexual harassment, assault, or other sexual offenses. Any guest or individual engaging in such behavior will be immediately reported to the local authorities, removed from the premises, and may face criminal charges.

6.2 Guest Responsibility: Guests are expected to respect the personal space and safety of other individuals at all times. Any sexual misconduct, including unwanted advances, inappropriate behavior, or physical assault, will not be tolerated.

6.3 Hotel's Commitment to Safety: The Hotel is committed to providing a safe environment for all guests. If a guest is a victim of a sexual offense or harassment while staying at the Hotel, they should immediately report the incident to the Hotel and local law enforcement. The Hotel will cooperate fully with investigations and take appropriate actions to ensure the safety of all its guests.
6.4 Immediate Eviction: Any guest found to be engaging in criminal behavior, including sexual offenses, will be evicted from the property immediately, without a refund, and will be reported to the relevant authorities for legal action.

7. Use of Facilities

7.1 Use of Swimming Pool: The swimming pool is available for use from 9:00 AM to 9:00 PM daily. Guests are requested to follow all pool rules and safety guidelines, which will be provided at check-in and are also posted in the pool area. The Hotel is not responsible for any injury, damage, or death that may occur while using the pool. There are no lifeguards on duty, and guests use the pool at their own risk.

7.2 Pool Access: Only registered guests are permitted to use the pool. Persons under the age of 18 must always be accompanied by an adult. Individuals who do not know how to swim are prohibited from entering the pool.

7.3 Prohibited Behavior: Parties, loud music, or fights are strictly prohibited in the pool area. The use of drugs in the pool area is also strictly prohibited. Nudity or sexual behavior is always prohibited. Guests must always maintain appropriate and respectful behavior.

7.4 Cleanliness: Guests must not dirty the pool or its surroundings. Failure to maintain cleanliness may result in fines. The consumption of food, beverages, or smoking is prohibited inside the pool.

8. Other Facilities

8.1 Luggage Room: The Hotel offers a luggage room for guests who arrive early or need to store their belongings after check-out. The Hotel is not responsible for any lost or stolen items in the luggage room.

8.2 Pool Table Use: The pool table is provided for guest enjoyment and must be used exclusively for playing billiards. Guests are responsible for the care and proper use of the table, as well as the pool balls and cues. It is strictly prohibited to damage or lose the table, balls, or cues, or to play in a rough or inappropriate manner. Any damage or loss to the pool table, balls, or cues will be the responsibility of the guest, and they will be charged for the repair or replacement costs.

8.3 Gym Use: The hotel provides a gym for guests' use. Guests must use the gym facilities in a safe and responsible manner. Proper attire, including athletic shoes, must always be worn. It is prohibited to engage in any reckless or disruptive behavior that could damage the equipment or pose a safety risk to others. Guests are responsible for wiping down equipment after use and maintaining cleanliness in the gym area. Guests are also responsible for their own safety while using the gym. Any injury, damage, or loss sustained while using the gym is at the guest’s own risk. Any damage to or loss of gym equipment will be the responsibility of the guest, and they will be charged for the repair or replacement costs. The hotel reserves the right to deny access to the gym for guests who do not adhere to these rules.

8.4 Guest Behavior: Guests must behave respectfully towards staff and other guests. Any disruptive, illegal, or inappropriate behavior may result in expulsion from the Hotel without a refund.
8.5 Damage Responsibility: The guest is responsible for any damage caused to the Hotel’s facilities or property during their stay.

9. Privacy Policy

9.1 Data Collection: The Hotel collects personal information from guests for the purposes of processing reservations and enhancing the guest experience.

9.2 Data Security: The Hotel is committed to protecting guests’ personal information through reasonable security measures. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All text messaging originator opt-in data and consent will not be shared with any third parties.

10. Hotel Liability

10.1 Limitation of Liability: The Hotel is not responsible for any damage or loss occurring within its premises.

10.2 Force Majeure: The Hotel will not be held responsible for failure to fulfill its obligations due to circumstances beyond its reasonable control, such as natural disasters, service disruptions, or public health emergencies.

11. Modifications to Terms

11.1 Changes to Terms and Conditions: The Hotel reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on the website and will take effect immediately upon publication.

12. Governing Law and Jurisdiction

12.1 Governing Law: These Terms and Conditions are governed by the laws of the State of Florida, United States, and any disputes will be subject to the jurisdiction of the courts in Miami, Florida.
